The following booking terms apply to every dancer and service provided by Topshelf Entertainment. Please make sure you supply accurate & complete information on the information form to ensure a successful event for all parties involved.
Deposits are mandatory for booking entertainment and vary according to the services and entertainer requested. In addition to your deposit, a $10 non-refundable processing fee will be charged at the time of booking to cover processing costs. Your deposit will be due upon booking.
All deposits are nonrefundable, subject to the limitations set forth herein:
A. Our entertainers always make every effort to arrive on time. If the entertainer does NOT arrive or is more than 30 minutes late, you are guaranteed a 100% full refund of your depositUNLESS the entertainer’s tardiness or the show is cancelled or altered due to:
1. Incorrect or insufficient information you supplied to us on the information form, including, but not limited to an incorrect address or incorrect contact phone number,
2. Your failure to answer the contact phone number provided on the information form when the entertainer calls needing help finding your location or gaining access to your building/apartment complex/subdivision/etc., or
3. You are not at the address you provided upon arrival of the entertainer.
4. If the entertainer is more than 30 minutes late but you agree to have the entertainer still perform for your show regardless of his or her tardiness.
5. Unfortunate or unforeseen circumstances beyond our control.
B. If we cannot provide the dancer or services you requested on the booking form, we will notify you prior to charging your credit card. You have the right to cancel based on the unavailability of the dancer or service.
- We accept Visa, MasterCard & Discover Credit or Debit Cards ONLY
- A processing fee of $10.00 will be added to all credit card deposit charges.
- We DO NOT accept personal checks, money orders, or any other form of payment.
- Please have your BALANCE DUE CASH payment ready upon delivery of the entertainment.
In the event that you have to cancel your reservation, your deposit is non-refundable. In the event you cancel within 24 hours of your reservation, you will be charged the full amount of your booking. Topshelf Entertainment may cancel your reservation if your credit or debit card is invalid, and/or we cannot reach you via phone or email.
4) CHANGES REQUESTED AFTER BOOKING:
If you request changes to your reservation after your booking has been scheduled, we will make every effort to accommodate the change. However, Topshelf Entertainment has the sole discretion to allow or deny any changes made to your reservation after booking.
5) ENTERTAINER SELECTION:
We can usually accommodate any requests for your choice of entertainer, however, the dancer of your choice is dependent on their availability. In order to fulfill your requests or preferences to the best of our ability, please give us your top two choices for one entertainer, your top four choices if 2 entertainers needed, etc. We will notify you if we cannot fulfill your request, or if any changes are necessary to complete your order PRIOR to charging your credit card for deposit purposes.
6) RESPONSIBILITIES OF THE PARTY HOST, DANCER(s), and TOPSHELF ENTERTAINMENT:
Topshelf Entertainment works very hard to ensure your party goes off without a hitch. We dot all our "i's" and cross our "t's", however, situations do arise from time to time that require special OR immediate action/attention.
a) MISCONDUCT & DISPUTES & PROBLEM SOLVING:
To help avoid any problems during the show, it is in your best interest to delegate someone; the best man/woman, party host, homeowner etc., to help maintain the crowd and handle any ruff play, fights, or unruly behavior. This is very important because any such problems may endanger your party and force us to cease the show and withdraw our entertainers immediately. Our entertainers are Topshelf and should be treated accordingly. Should a problem arise, you must call the office of Topshelf Entertainment during the show so that we may rectify the problem immediately. If no one is in the office to handle your call, you MUST leave a DETAILED VOICE MESSAGE regarding the circumstances of your claim. We will respond the following BUSINESS DAY. Failure to call or leave a message during your event will result in possible termination of the show without any consideration for a full or partial refund.
You must be willing to settle any disputes reasonably, logically, and within legal parameters within a reasonable amount of time and with a clear head. Drunken or violent arguments or unreasonable requests will not be tolerated or considered for any refunds.
You will indemnify, defend, and hold harmless Topshelf Entertainment, including its officers, directors, employees, affiliates, licensors, information providers, and agents ("collectively, Topshelf Entertainment Affiliates) from and against all losses, claims, liabilities, expenses, damages, and costs, including attorney’s fees, resulting from any violation of these terms or any activity related to the service including negligent or wrongful conduct by you or your invitee, or by any other person booking your reservation.
8) LIMITATION OF LIABILITY:
To the fullest extent permitted under law, Topshelf Entertainment, Inc., will have no liability (whether arising in contract, warranty, tort, including negligence, product liability, or otherwise) for any direct, indirect, incidental, special, or consequential damages or liabilities (including loss of revenue or profit) arising with respect to use of our services.
9) CHOICE OF LAW:
The state and federal courts of Georgia are the exclusive forum and venue to resolve any and all disputes arising out of or otherwise relating to these Terms. You consent to personal jurisdiction and venue by the state and federal courts of the State of Georgia .
10) AGREEMENT TO TERMS:
By checking the “Booking Terms” box on the Topshelf Entertainer online booking form, this acts as your signature. By checking this box, you have authorized us to charge your credit or debit card for the deposit pursuant to the terms of this agreement. You agree that you are the cardholder on this agreement, that you are the client booking our services, and that you consent to the “Booking Terms” Agreement. You warrant that you are at least 18 years old and possess the legal authority to enter into this agreement in accordance with the terms and conditions of this agreement. You agree to be financially responsible for your use of our services as well as the use of your name and credit card account to pay for services purchased from us. You also warrant that all information supplied by you is true and accurate.
